This Legal Notices page consolidates supplemental legal disclosures applicable to your use of the Platform operated by Fine Wines Health LLC ("Company"). These Notices supplement, and are incorporated into, the Company's Terms and Conditions and Privacy Policy. Capitalized terms not defined here have the meanings given in those documents.
SECTION A — COOKIE POLICY
A1. WHAT ARE COOKIES
Cookies are small text files placed on your device by websites you visit. The Platform uses cookies and similar technologies — including pixel tags, web beacons, local storage, and session tokens — to operate, analyze, and improve the Platform.
A2. TYPES OF COOKIES WE USE
Strictly Necessary Cookies
Required for the Platform to function. These enable core features such as authentication, session management, and security. The Platform cannot function without these cookies and they cannot be disabled.
Analytics and Performance Cookies
Help us understand how users interact with the Platform, identify technical issues, and measure performance. Information collected is aggregated and does not identify individual users. Examples include cookies set by analytics services such as Google Analytics.
Functional Cookies
Remember your preferences and settings (such as language and time zone) to improve your experience. Disabling these cookies may affect Platform functionality.
Advertising and Targeting Cookies
The Company may use limited advertising measurement technologies on unauthenticated public pages (such as marketing landing pages) to measure the effectiveness of advertising campaigns. We do not use advertising cookies or tracking technologies on authenticated pages (such as patient portals) and do not share PHI or sensitive health information with advertising networks or social media platforms. See Section A4 for opt-out options.
A3. THIRD-PARTY COOKIES
Some cookies on the Platform are set by third-party service providers, including analytics providers and payment processors. We require these providers to comply with applicable privacy laws. Third-party cookies are subject to those providers' own privacy policies.
A4. YOUR COOKIE CHOICES
You may manage cookies through your browser settings or, where applicable, through a Global Privacy Control (GPC) signal. Most browsers allow you to refuse, delete, or receive notice of cookies. Note that disabling certain cookies may impair Platform functionality. We honor GPC signals for users in states where such signals are legally recognized. For California residents, you may opt out of the sharing of personal information for cross-context behavioral advertising at https://finewineshealth.com/pages/your-privacy-choices.
A5. COOKIE RETENTION
Session cookies are deleted when you close your browser. Persistent cookies remain for a set period (typically 12 to 24 months) or until deleted by you. You can clear cookies at any time through your browser settings.
SECTION B — ACCESSIBILITY STATEMENT
B1. COMMITMENT TO ACCESSIBILITY
The Company is committed to ensuring that the Platform is accessible to individuals with disabilities in accordance with applicable law, including the Americans with Disabilities Act ("ADA"), Section 508 of the Rehabilitation Act, and Section 1557 of the Affordable Care Act. We strive to meet or exceed the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards.
B2. ACCESSIBILITY FEATURES
The Platform is designed to support accessibility, including:
- Keyboard navigation compatibility;
- Screen reader compatibility using ARIA roles and semantic HTML;
- Sufficient color contrast ratios for text and interactive elements;
- Alternative text for meaningful images;
- Scalable text that can be resized without loss of functionality;
- Captions or transcripts for audio and video content, where applicable.
B3. REPORTING ACCESSIBILITY ISSUES
If you experience difficulty accessing any feature or content on the Platform, or if you need information in an alternative format, please contact us using the information in the Contact section below. We will make reasonable efforts to provide accessible alternatives and to address accessibility barriers promptly.
B4. LANGUAGE ASSISTANCE
If you require language assistance services to access the Platform or clinical services, please contact us. We will make reasonable efforts to provide language access at no cost to you, in accordance with applicable law including Section 1557 of the ACA.
SECTION C — NON-DISCRIMINATION NOTICE
C1. NON-DISCRIMINATION POLICY
The Company and the PC do not discriminate against any person on the basis of race, color, national origin, sex (including pregnancy, sexual orientation, and gender identity), age, disability, religion, or any other characteristic protected under applicable federal, state, or local law, including:
- Title VI of the Civil Rights Act of 1964 (race, color, national origin);
- Title IX of the Education Amendments of 1972 (sex);
- Section 504 of the Rehabilitation Act of 1973 (disability);
- The Age Discrimination Act of 1975 (age);
- Section 1557 of the Patient Protection and Affordable Care Act (all of the above).
This policy applies to all programs, services, activities, and facilities of the Company and the PC.
C2. REASONABLE ACCOMMODATIONS
We will provide reasonable accommodations to individuals with disabilities and reasonable modifications to our practices to ensure equal access to our services. If you need an accommodation to use the Platform or access clinical services, please contact us.
C3. HOW TO FILE A DISCRIMINATION COMPLAINT
If you believe you have been discriminated against in violation of this policy, you may:

- File a complaint with the U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/ocr or 1-800-368-1019 (TDD: 1-800-537-7697);
- File a complaint with the U.S. Department of Justice at www.ada.gov;
- File a complaint with your state civil rights enforcement agency.
We will not retaliate against any person for filing a complaint or participating in a discrimination investigation.
SECTION D — SMS / TEXT MESSAGING TERMS
D1. PROGRAM DESCRIPTION
By providing your mobile telephone number and opting in to SMS communications, you consent to receive text messages from the Company and the PC. Message types may include: appointment reminders and confirmations; intake instructions; administrative notifications; account alerts; and, if you separately opt in, promotional and marketing messages.
D2. CONSENT AND OPT-IN
SMS consent is obtained at the time you provide your mobile number through the Platform or at intake. Consent to receive SMS messages is not a condition of receiving clinical services. Standard message and data rates from your mobile carrier may apply. Message frequency varies based on your account activity and program enrollment.
D3. OPT-OUT
You may opt out of SMS messages at any time by replying STOP to any text message from us. You will receive a single confirmation message and no further messages will be sent, except as required to complete an active transaction or as required by law. To opt back in, reply START or contact us.
D4. HELP

D5. SUPPORTED CARRIERS
SMS messaging is available on most major U.S. carriers. Carrier support is not guaranteed. The Company and PC are not responsible for delayed or undelivered messages.
D6. HIPAA AND HEALTH INFORMATION VIA SMS
Unencrypted SMS messages are not a secure communication channel. You acknowledge that sending or receiving health information via SMS involves inherent security risks. You may opt out of health-related SMS communications at any time without affecting your access to clinical services through the Platform's secure messaging features.
SECTION E — AI AND AUTOMATED TOOLS DISCLOSURE
E1. USE OF AUTOMATED TOOLS
The Platform may use automated tools, algorithms, and artificial intelligence ("AI") technologies to support Platform operations. Current uses may include, without limitation:
- Intake form processing and routing;
- Appointment scheduling and matching;
- Administrative triage and intake questionnaire analysis;
- Automated reminders and communications;
- Platform security, fraud detection, and abuse prevention;
- Analytics and Platform improvement.
E2. NO CLINICAL DECISION-MAKING BY AI
AI and automated tools used by the Company are used for administrative and operational purposes only. No AI or automated system makes clinical diagnoses, treatment decisions, or medical recommendations. All clinical decisions are made exclusively by licensed Providers affiliated with the PC, who exercise independent professional judgment. The use of AI tools by the Company does not create a clinical relationship between you and the Company.
E3. STATE DISCLOSURE REQUIREMENTS
Several states require disclosure when AI is used in healthcare-related contexts. By using the Platform, you acknowledge that automated tools may be used as described in this Section. If you have questions about whether a specific interaction involved automated processing, or if you wish to request human review of an automated decision that affected your access to services, please contact us using the information below.
E4. DATA USE IN AI SYSTEMS
To the extent personal information or Health Information is processed by automated tools, such processing is subject to the Privacy Policy, the Notice of Privacy Practices, and applicable law. The Company does not use PHI to train external AI models without your express authorization and does not share identifiable health information with AI vendors except pursuant to a Business Associate Agreement or equivalent data protection agreement.
E5. UPDATES TO AI TOOLS
AI and automated tools are updated periodically. Material changes to how AI is used in ways that affect your rights or the delivery of services will be disclosed through updates to this Legal Notices page.
