Purpose
This Telehealth Informed Consent ("Consent") explains what telehealth is, the benefits and limitations of telehealth, your rights, and what you consent to when you use telehealth Services offered through Fine Wines Health, Inc. ("Fine Wines Health"). You must read, acknowledge, and agree to this Consent before your first telehealth visit and any time it is materially updated.
What Telehealth Is
Telehealth is the delivery of healthcare services using secure audio, video, and messaging technology, enabling you to consult with a licensed clinician without an in-person visit. Through our platform, you may interact with a clinician for evaluation, treatment planning, education, prescription management where clinically appropriate, and follow-up care.
Who Provides Your Care
Telehealth visits are provided by independently licensed clinicians who practice under their own license in the state where you are physically located during the visit. Fine Wines Health operates the technology platform and administrative support. Clinicians are solely responsible for the medical services they provide and for the exercise of independent clinical judgment.
Expected Benefits
- Convenient access to care from your home or another private location.
- Reduced travel time and scheduling flexibility.
- Coordination with pharmacies and laboratories, where clinically appropriate and with your consent.
Potential Risks and Limitations
- Telehealth depends on technology. Connectivity issues, device malfunctions, or service interruptions may affect the quality or completion of a visit.
- The absence of a physical examination may limit your clinician's ability to diagnose or treat certain conditions. Your clinician may recommend an in-person evaluation.
- Despite secure technology and administrative safeguards, there is a risk, albeit low, that electronic communications could be intercepted or accessed by unauthorized persons.
- Not every condition is appropriate for telehealth. Your clinician will advise if a different level of care is required.
Scope of Services and Prescriptions
Your clinician will determine, in their sole clinical judgment, whether treatment (including prescription medication) is appropriate. Prescriptions, where issued, are sent to a licensed pharmacy for fulfillment. Controlled substances are prescribed only where permissible under federal and state law and only when clinically indicated. Fine Wines Health does not guarantee that any particular medication will be prescribed.
State Licensure and Geographic Limits
Telehealth visits are available only in states where our contracted clinicians are licensed and where telehealth is permitted under state law. You must be physically located in an eligible state at the time of the visit. You are responsible for providing accurate location information. If you relocate, you may need to transition to a clinician licensed in your new state.
Emergencies
Telehealth is not a substitute for emergency care. If you are experiencing a medical emergency, including but not limited to symptoms of stroke, heart attack, severe bleeding, severe allergic reaction, thoughts of self-harm, or other urgent conditions, call 911 or go to the nearest emergency department immediately. Our platform is not monitored for emergencies and is not appropriate for urgent care needs.
Medical Records and Privacy
Your clinician maintains a medical record of your care in a HIPAA-compliant system. You have the right to inspect and obtain a copy of your records, to request corrections, and to receive a copy of our HIPAA Notice of Privacy Practices. Information you provide through the telehealth platform may be shared with the pharmacy fulfilling your prescription, with laboratories performing tests you consent to, and with others only as permitted under HIPAA or with your authorization.
Recording and Documentation
Your clinician will document each visit. Visits are not recorded (audio or video) unless you are given notice and provide additional written consent.
Consent to Treatment
By acknowledging this Consent and participating in a telehealth visit, you consent to evaluation and treatment by the clinician using telehealth technology; you confirm you understand the benefits, risks, and limitations; and you acknowledge that no guarantee has been made regarding the outcome of any treatment.
Rights
- You may withhold or withdraw consent at any time without affecting your right to future care.
- You may request an in-person evaluation if available and clinically appropriate.
- You may ask questions about the technology, security, and clinical process.
- You may obtain an alternative type of care through a provider of your choice.
Fees and Insurance
Telehealth visit fees and any associated pharmacy or laboratory fees are disclosed at the time of booking. Fine Wines Health is generally an out-of-pocket, cash-pay service and does not bill insurance at this time. Lab services and certain medications may be billed separately.
